Terms of Service

1. Definitions

For purposes of these Terms, "Realies HQ," "we," "us," and "our" refer to the operator of the Service. "You," "your," and "User" refer to the individual or legal entity accessing or using the Service. "Service" means the Realies HQ website at https://realies.ttmdev.xyz/, the Realies HQ Discord bot and application, verification pages, authentication flows, security systems, administrative dashboard, databases, logs, interfaces, documentation, software, and related functionality. "Discord" means the third-party communications platform operated by Discord Inc. "Server" means the private Realies HQ Discord server. "Staff" or "Administrator" means an individual authorized to administer the Server or Service. "Content" means information, text, images, identifiers, records, logs, configurations, submissions, and other material that is transmitted to, generated by, or processed through the Service.

2. Agreement and Electronic Acceptance

Your use of the Service may constitute electronic acceptance of these Terms. Actions that may constitute acceptance include visiting or using the website, clicking an authorization or verification control, authenticating through Discord, completing verification, interacting with the bot, joining or remaining in the Server after notice of these Terms, or using functionality made available through the Service.

You represent that you have legal capacity to enter into these Terms or, if acting for an organization, that you have authority to bind that organization. If you do not have such authority, you may not use the Service on behalf of that organization.

These Terms, together with the Privacy Policy and any rules expressly incorporated by reference, constitute the agreement governing your use of the Service. If a specific feature has additional terms presented at the time of use, those terms may supplement these Terms for that feature.

3. Independent Relationship With Discord

Realies HQ is an independent third-party service. It is not owned, operated, sponsored, endorsed, or administered by Discord Inc. Discord is not a party to these Terms and is not responsible for the Service.

Your use of Discord remains subject to Discord's then-current Terms of Service, Privacy Policy, Community Guidelines, Developer Terms, Developer Policy, and other applicable Discord rules. Nothing in these Terms modifies, replaces, or supersedes your agreement with Discord.

The Service may use Discord OAuth2 or other Discord-provided authentication functionality. The Service does not request your Discord password and should never be provided with your password, authentication codes, recovery codes, or similar credentials.

4. Eligibility

You may use the Service only if you are legally permitted to do so and satisfy applicable age and eligibility requirements. The Service is not directed to children under 13. If Discord or applicable law establishes a higher minimum age for your location or circumstances, that higher requirement applies.

You must not use the Service if your use would violate applicable law, a court order, sanctions, export restrictions, Discord rules, or another binding legal requirement.

We may restrict access where we reasonably believe an eligibility requirement is not satisfied, where required by law, or where restriction is reasonably necessary to protect the Service, the Server, other users, or third parties.

5. Private Community and Access Control

Realies HQ is configured as a private community. Access to the Server is not guaranteed. Server membership, verification, role assignment, channel visibility, quarantine status, and other permissions may be changed by authorized Staff or by automated security functions.

A Discord invitation, verification page, previous membership, or previous verification does not create a permanent entitlement to access the Server. The operator and authorized Staff may restrict, remove, suspend, quarantine, or deny access in accordance with these Terms, Server rules, Discord requirements, and applicable law.

6. Verification

Realies HQ may require verification before granting access to ordinary Server channels. Verification may require authentication through Discord and technical security checks intended to reduce abuse, spam, raids, account cycling, and other security risks.

During verification, the Service may confirm that the authenticated Discord account is a current member of the Realies HQ Server. The Service may then create or update a verification record and, when technically successful, assign a verified role or otherwise release the account from an unverified restriction.

Verification is a technical access-control process. It is not a statement that a person is honest, trustworthy, safe, lawful, or free from malicious intent. Verification does not guarantee future access.

7. Authentication and OAuth2

Authentication may be performed using Discord OAuth2. When you authorize the application, Discord may provide information permitted by the scopes and permissions presented to you. The Service may use that information to authenticate your account, confirm Server membership, associate a verification record with your Discord account, and provide administrative security functionality.

You are responsible for maintaining the security of your Discord account and for reviewing Discord's authorization screen before approving access. If you believe your Discord account has been compromised, you should secure the account through Discord's official procedures.

We do not guarantee that Discord authentication will remain continuously available. Changes, outages, rate limits, policy changes, API changes, or restrictions imposed by Discord may affect authentication.

8. Security Screening

The Service may perform technical checks during or after verification. Depending on the current implementation, those checks may include account-age calculations derived from a Discord identifier, local network intelligence, known VPN/proxy/TOR indicators, join-burst information, duplicate indicators, previous security records, and other signals reasonably related to Server security.

Security checks are designed to reduce abuse and assist authorized Staff. They are not designed to provide a definitive identification of a person or a definitive determination that a person is malicious.

Security information can be incomplete or inaccurate. A VPN, proxy, TOR endpoint, mobile network, corporate network, privacy service, carrier NAT, or other network arrangement may be misclassified or may not be detected. Conversely, an address associated with a security service does not by itself establish wrongdoing.

9. Risk Scores

The Service may calculate a numerical or categorical risk score for security purposes. A risk score is an internal operational signal and is not a credit score, criminal-history determination, identity verification, legal conclusion, or statement about a person's character.

Risk calculations may use multiple technical indicators and configurable thresholds. Thresholds may be changed by authorized administrators. The system may produce different results for different accounts or at different times because the underlying information, configuration, or security environment may change.

Users acknowledge that automated risk scores are probabilistic security indicators rather than perfect determinations. We make no representation that a risk score will detect every malicious account or prevent every security incident.

10. Automated Actions

Subject to configuration, the Service may automatically assign an unverified role, apply a quarantine role, restrict access, record a security event, or trigger another security action when predefined conditions are satisfied.

Automated actions may occur without advance individual notice where immediate action is reasonably necessary to protect the Server or users. Authorized Staff may manually review, modify, reverse, or supplement automated actions where the available tools permit.

An automated action does not constitute a finding of legal wrongdoing. It is an access-control or security response based on the system's configuration and available signals.

11. Quarantine

The Service may place an account in quarantine where security thresholds or Staff decisions indicate that restricted access is appropriate. Quarantine may limit visibility, messaging, voice access, or other Server functions.

Quarantine may be temporary or indefinite. Release may occur automatically, through successful verification, or through authorized Staff action. The operator does not guarantee that a quarantined account will be released within a particular time.

12. Moderation and Staff Authority

Authorized Staff may use the Service to assist with warnings, removals, bans, quarantine, verification management, security configuration, logging, and other Server-management functions. Staff actions may be based on information available through Discord, the Service, reports, observations, or security systems.

The operator does not guarantee that every Staff action is correct, consistent, complete, or reversible. Staff remain responsible for using administrative powers lawfully and consistently with the Server's rules and applicable law.

Nothing in these Terms creates an employment, agency, fiduciary, partnership, or representative relationship between a user and Realies HQ Staff.

13. Acceptable Use

You agree not to use the Service to violate law, violate Discord rules, interfere with the Service, compromise accounts, evade legitimate security controls, impersonate another person, distribute malicious software, attempt unauthorized access, abuse authentication flows, exploit vulnerabilities without authorization, harvest information for unauthorized purposes, or interfere with another person's use of the Service.

You must not intentionally provide false information for the purpose of bypassing verification or security controls. You must not attempt to manipulate, poison, falsify, or circumvent risk signals, verification records, security logs, role controls, or anti-raid systems.

You must not reverse engineer, decompile, disassemble, extract source code, circumvent technical restrictions, or create derivative services from protected portions of the Service except where a non-waivable legal right expressly permits such activity.

14. Security Research and Responsible Testing

Security testing may not be conducted against the Service without authorization. Prohibited testing includes credential attacks, denial-of-service activity, destructive testing, data extraction, privilege escalation, social engineering, intentional disruption, and attempts to access information belonging to another user.

Nothing in these Terms prohibits a person from exercising a non-waivable right under applicable law. However, where authorization is required, users should obtain authorization before testing.

15. Rate Limits and Abuse Controls

The Service may use rate limits, authentication limits, session controls, anti-raid thresholds, request filtering, temporary blocks, and other safeguards. These controls may occasionally affect legitimate activity, particularly during outages, unusual traffic, or security incidents.

Attempting to evade a rate limit or abuse-control mechanism may result in restriction or termination of access.

16. User Content and Communications

The Service may receive or process information generated through your use of the verification system. Discord messages and Server content may remain governed primarily by Discord and the Server's own administration. The Realies HQ Service should not be treated as a private communications channel merely because it is accessible through the Server.

You are responsible for information you voluntarily submit through forms or other interfaces. Do not submit passwords, payment-card numbers, government identification numbers, private encryption keys, recovery codes, or other information that the Service does not request.

17. Privacy

Information processed through the Service is described in the Realies HQ Privacy Policy. The Privacy Policy is incorporated into these Terms by reference for purposes of describing information practices.

By using the Service, you acknowledge that technical information may be processed as described in the Privacy Policy for authentication, verification, security, fraud prevention, administration, compliance, and operation of the Service.

18. Data Accuracy

You acknowledge that information received from Discord, network intelligence sources, technical systems, or user input may be incomplete, stale, unavailable, or inaccurate. We do not guarantee that third-party data is current or error-free.

Where a security record is demonstrably incorrect and correction is technically and legally appropriate, the operator or authorized Staff may correct the record. Correction does not require deletion of information that must lawfully or legitimately be retained.

19. Intellectual Property

Except for third-party materials and user-owned content, the Service, including its software, design, text, interface structure, branding, graphics, configuration, database structure, documentation, and original content, is owned by or licensed to the operator.

You receive a limited, revocable, non-exclusive, non-transferable right to use the public-facing Service for its intended purpose. No ownership rights are transferred to you.

You may not copy, reproduce, republish, sell, sublicense, distribute, publicly perform, publicly display, modify, create derivative works from, or commercially exploit protected portions of the Service without authorization, except to the extent applicable law expressly permits.

20. Feedback

If you provide suggestions, ideas, bug reports, feature requests, or other feedback, you grant the operator a non-exclusive, worldwide, royalty-free right to use, reproduce, modify, and incorporate that feedback into the Service without compensation or attribution, subject to applicable law.

You should not submit confidential trade secrets or sensitive information as feedback.

21. Third-Party Services

The Service may depend on Discord, hosting providers, database providers, authentication services, network-intelligence data, content-delivery systems, and other third-party infrastructure. Third-party services are outside our complete control.

We are not responsible for third-party outages, API changes, rate limits, account suspensions, data-processing practices, security incidents, content, policies, or failures. Your use of third-party services remains subject to their own terms and policies.

22. Availability

The Service is provided on an availability-dependent basis. We do not promise continuous, uninterrupted, error-free, secure, or permanently available operation.

Service availability may be affected by maintenance, software updates, hosting outages, database failures, Discord outages, network failures, attacks, configuration changes, provider restrictions, emergencies, or circumstances beyond reasonable control.

We may suspend or modify any feature without advance notice where reasonably necessary for security, maintenance, legal compliance, emergency response, or operational reasons.

23. Changes to the Service

We may modify, replace, remove, suspend, or discontinue features. Security thresholds, role behavior, verification flows, dashboard functions, data structures, and user interfaces may change as the Service evolves.

We do not guarantee that a feature available today will remain available indefinitely.

24. No Professional Advice

The Service does not provide legal, financial, medical, cybersecurity consulting, identity-verification certification, or other professional advice. Security information is operational information only and should not be treated as professional advice.

25. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE OPERATOR DISCLAIMS WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY, EXCEPT TO THE EXTENT SUCH DISCLAIMERS ARE PROHIBITED BY LAW.

WE DO NOT WARRANT THAT THE SERVICE WILL IDENTIFY EVERY FRAUDULENT, MALICIOUS, AUTOMATED, COMPROMISED, OR OTHERWISE ABUSIVE ACCOUNT. WE DO NOT WARRANT THAT VPN, PROXY, TOR, ACCOUNT-AGE, RAID, OR OTHER SECURITY SIGNALS WILL ALWAYS BE DETECTED CORRECTLY.

WE DO NOT WARRANT THAT ACCESS TO THE SERVER WILL BE AVAILABLE, THAT VERIFICATION WILL SUCCEED, THAT A PARTICULAR ROLE WILL BE ASSIGNED, OR THAT ANY MODERATION DECISION WILL BE REVERSED.

26. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, SERVICE PROVIDERS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR SIMILAR LOSSES ARISING FROM OR RELATING TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO THE OPERATOR FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100), UNLESS APPLICABLE LAW PROHIBITS SUCH LIMITATION.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability that applicable law makes non-waivable.

27. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the operator and its owners, officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and reasonable expenses arising from or related to your unlawful use of the Service, your violation of these Terms, your violation of Discord rules, your infringement of third-party rights, your intentional abuse of security controls, or your misconduct in connection with the Service.

This section does not require indemnification to the extent a claim results from the operator's own conduct where applicable law prohibits such allocation.

28. Suspension and Termination

We may suspend or terminate access to the Service, in whole or in part, where reasonably necessary to protect the Service or Server, prevent abuse, comply with law, respond to security incidents, enforce these Terms, respond to Discord restrictions, or protect users or third parties.

Suspension may be temporary or indefinite. Termination of access does not automatically terminate provisions that by their nature should survive, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, governing law, and interpretation.

29. Server Removal

Realies HQ Staff may remove a member from the Discord Server independently of website access. Website verification does not override Discord permissions, Server rules, moderation decisions, or other access controls.

30. Dispute Resolution

Before commencing a formal legal proceeding concerning the Service, the parties should, where legally permissible, attempt to resolve the dispute informally through the available service or Server administration channels. This informal step does not waive a non-waivable statutory right or prevent a party from seeking emergency relief where legally available.

If a dispute cannot be resolved informally, the parties may be required, to the extent enforceable under applicable law, to resolve the dispute through individual arbitration rather than a class or representative proceeding. Any arbitration provision is intended to be applied only to the maximum extent permitted by applicable law and does not eliminate rights that cannot lawfully be waived.

31. Class and Representative Proceedings

To the maximum extent permitted by applicable law, disputes subject to an enforceable arbitration agreement must be brought on an individual basis and not as a plaintiff or class member in a class, collective, consolidated, or representative action. Where applicable law prohibits such a waiver, the prohibited portion will be severed or limited as required by law.

32. Governing Law

To the extent legally permitted, these Terms and disputes arising from the Service will be governed by the laws of the applicable United States jurisdiction selected by the operator for the Service, without regard to conflict-of-law rules that would require application of another jurisdiction's law. Nothing in this section is intended to deprive a consumer of mandatory rights under the law of the consumer's state or another jurisdiction where those rights cannot lawfully be waived.

33. Venue

Where court proceedings are permitted, venue will be determined according to applicable law and any enforceable forum-selection provision. Nothing in these Terms prevents a consumer from asserting rights in a forum that applicable law requires to remain available.

34. Force Majeure

We will not be responsible for delay or failure caused by circumstances beyond reasonable control, including natural disasters, war, terrorism, civil unrest, labor disruptions, government actions, telecommunications failures, Internet outages, infrastructure failures, cyberattacks, denial-of-service attacks, provider failures, Discord outages, database outages, or other events that could not reasonably be prevented or controlled.

35. Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable where permitted, and the remaining provisions will continue in effect. If modification is not permitted, the invalid provision will be severed without invalidating the remainder.

36. No Waiver

A failure to enforce a provision does not constitute a waiver of the right to enforce that provision later. A waiver is effective only to the extent expressly made and does not constitute a continuing waiver unless expressly stated.

37. Assignment

You may not assign or transfer your rights or obligations under these Terms without authorization. We may assign or transfer these Terms in connection with a merger, acquisition, corporate restructuring, sale of assets, financing, or transfer of the Service, subject to applicable law.

38. Entire Agreement

These Terms and the Privacy Policy, together with any feature-specific terms expressly incorporated by reference, constitute the agreement concerning your use of the Service. They supersede prior representations concerning the same subject matter to the extent permitted by law.

39. Interpretation

Headings are provided for convenience and do not limit the meaning of a provision. Words such as "including" mean "including without limitation" unless applicable law requires otherwise. References to laws include amendments and successor provisions to the extent applicable.

40. Changes to These Terms

We may revise these Terms to reflect changes in the Service, security architecture, applicable law, Discord requirements, business practices, or risk environment. The updated version will be posted on this page with a revised Last Updated date.

Where applicable law requires additional notice or consent for a material change, the operator will follow that requirement. Otherwise, continued use of the Service after publication of an updated version constitutes acceptance to the extent permitted by law.

41. Survival

Sections that by their nature should survive termination will survive, including definitions where necessary, intellectual-property provisions, disclaimers, limitations of liability, indemnification, dispute-resolution provisions, governing-law provisions, privacy-related obligations, and interpretation provisions.

42. No Guarantee of Enforcement Outcome

These Terms are intended to establish reasonable contractual rules and protections. No contractual language can guarantee that every provision will be enforced in every jurisdiction or circumstance. Mandatory consumer, privacy, employment, accessibility, or other statutory rights remain subject to applicable law.

43. No Waiver of Mandatory Rights

Nothing in these Terms is intended to waive a right that applicable law makes non-waivable. Where a provision conflicts with a mandatory legal requirement, the mandatory requirement controls only to the extent of the conflict.

44. Acknowledgment

By using Realies HQ, you acknowledge that you have read these Terms, understand that the Service includes automated security and access-control features, understand that security checks can produce false positives or false negatives, understand that Discord is a separate third-party service, and agree to use the Service responsibly and lawfully.
